The trial of Erin Patterson — accused of poisoning three relatives with a beef Wellington dish allegedly containing death cap mushrooms — continues at the Latrobe Valley Law Courts in Morwell.
Court Proceedings and Evidence Review
Phone Evidence in Focus
Detective Leading Senior Constable Stephen Eppingstall is under questioning by defence barrister Colin Mandy SC. The court heard details about multiple phones and SIM cards linked to the case. It was revealed that:
- Not all SIM card activity was tracked.
- One phone (referred to as “phone B”) was reset in May 2023 and used again in August.
- A delay of 12 hours between a message being sent and received on one number was cited as a limitation in the extracted data.
A flow chart presented in court showed a particular SIM card — ending in 783 — was used in at least seven different devices between 2019 and 2023.
Communications Not Fully Retrieved
There were also discussions around incomplete access to messages exchanged between Don and Gail Patterson and Erin Patterson, raising questions about the scope of police data collection.
Changes in the Home
Photos from a police search at Erin Patterson’s house on November 2, 2023, were shown. Compared to a previous search in August, certain items — like a keyboard — were no longer visible. The court agreed the shelves had been “rearranged.”
Other photos from the August search displayed a variety of plates found in Patterson’s kitchen, which the defence highlighted in questioning.
Technical Issues and Lighter Moments
There was a brief disruption when a juror had trouble viewing evidence on a tablet. Justice Christopher Beale lightheartedly suggested a reboot, noting it “solves about 95 per cent of problems,” prompting laughter in the courtroom.
Recap of Previous Proceedings
Last week, the court heard a 21-minute police interview with Erin Patterson, recorded one week after the fatal lunch. The prosecution claims she lied about foraging mushrooms, though her defence argues that she is not a killer.
Trial Continues
The trial, which is drawing significant public attention, will continue today with further witness testimony and evidence presentation.
