The trial of Gareth Ward, the Independent MP for Kiama and former New South Wales Cabinet Minister, began in the NSW District Court on Monday, where he is facing allegations of sexual and indecent assault involving two men.
Mr Ward has pleaded not guilty to all five charges: one count of sexual assault and four counts of indecent and common assault.
Allegations Detailed in Court
During her opening address, the Crown prosecutor alleged Mr Ward indecently assaulted an 18-year-old man in 2012 and sexually assaulted a 27-year-old man in 2015.
The court heard that the first complainant, who had just turned 18 at the time, accepted an invitation to Mr Ward’s home at Meroo Meadow after drinking and arguing with his girlfriend. Once there, he discovered he was alone with Mr Ward.
It is alleged Mr Ward touched the young man’s buttocks and scrotum while he wore loose shorts, then climbed on his back under the guise of giving a massage, pressing his groin against him.
“The accused did not comply when initially asked to stop,” the prosecutor told the court.
Mr Ward faces three charges of indecent assault and one of common assault in relation to this incident. The complainant’s identity is protected by law.
Second Complainant’s Allegations
The second complainant, who was 24 at the time of the alleged 2015 incident, claims he was invited to Mr Ward’s Potts Point apartment after an event at NSW Parliament House.
The two had drinks, and Mr Ward allegedly tried to kiss him. Though the man allowed a second kiss, he withdrew when Mr Ward’s tongue entered his mouth.
Later, while the complainant was in bed in his boxer shorts, Mr Ward allegedly got into bed with him, tried to put his arm around him, and then inserted his finger into the man’s anus while kissing and masturbating.
“He was confused, couldn’t sleep, and didn’t know why he didn’t leave,” the prosecutor told the court. The next morning, Mr Ward allegedly apologised, saying he was sorry if he made the man feel uncomfortable.
The second complainant’s identity is also legally protected.
Trial to Hear from High-Profile Witnesses
Mr Ward was present in court and formally pleaded not guilty as the charges were read to the jury. His legal team has not yet responded to the Crown’s opening statement.
The trial is expected to hear testimony from several former Liberal politicians, including Don Harwin, Shelly Hancock, Jo Gash, and Anne Sudmalis.
Social media commentator Jordan Shanks, also known as Friendly Jordies, has also been named as a witness.
The trial is scheduled to run for four weeks, with witness testimony beginning on Wednesday.
